Orlando HOAs Revealed!

Recently, I had a potential buyer call me about moving to Orlando from New Jersey. This particular buyer was interested in the neighborhood of Hunters Creek, FL because he had a young family and he knew that Hunters Creek was voted the 21st best place to live in the U.S. just a couple of years ago. In our first conversation, he says to me “Whatever, you don’t show me any houses where there is a homeowners association”. I can’t say I was surprised to hear this, I hear it all of the time. There’s a lot of bad press about HOAs, especially when it comes to short sales and trying to negotiate with them on discounting the amount owed by a seller, but that’s a different subject altogether.

My first order of business as an Orlando real estate agent was to tell this buyer that every neighborhood in Hunters Creek is governed by an HOA. I then had to educate him on how communities like these put HOAs in place to protect their residents. Imagine if everyone was allowed to paint their house any color they wanted…Yikes!!! or what if residents didn’t have to pick up after their dogs? It would be total Chaos!

I knew that if I was going to keep him as a client I would have to do one of two things; either find him another neighborhood to live in or convince him that not all HOAs are evil. It forced me to do some deep research about HOA’s. See below.

What’s An HOA?

An HOA is an organization in a planned community or condominium that makes and enforces rules for the properties under its jurisdiction. An HOA survives by collecting fees, either monthly or quarterly to pay for the upkeep of the community’s common areas like soccer fields, dog parks, tennis courts, community centers, etc. They also enforce the community rules AKA “the Declaration of Covenants, Conditions, and Restrictions”. If there weren’t a set of rules in place, the neighborhood would be much less appealing. These are the rules that keep your neighbor from painting her house bright purple or parking their RV in the driveway. It’s true that sometimes HOAs can be overly strict in some cases, but it’s always in the best interest of the community.

What Do HOAs Cover?

It depends on what community you’re talking about because every HOA is different. You can find out what any particular HOA covers simply by contacting the one that runs the community that you’re interested in.

Who or What Runs The HOA?

The HOA is run by the Covenants, Conditions & Restrictions AKA the CC&Rs. This will decide how a HOA will function including but not limited to: what’s allowed, what’s not allowed, and how elections and assessments are managed. Typically, there’s a Board of Directors that are unpaid residents of the community that make sure that the community rules and restrictions are followed and enforced. Also, there’s a management company that’s hired to collect fees and schedule maintenance to common grounds like landscapers, park maintenance, etc.

What Happens If You Don’t Pay Your HOA Fees?

The HOA has the right to put a lien on your property for non-payment. If the homeowner doesn’t pay the fees for whatever reason, the HOA can actually have the ability to foreclose on the property. This may be hard to believe but it happens all the time here in Orlando. Even though the mortgage company is in the first position if it goes into foreclosure, the HOA has the right to receive up to one year’s worth of HOA dues under Florida law

Why Do Some HOA Fees Increase?

The short answer is inflation. The fees that you pay to your HOA are based on the budget that was determined for that fiscal year. The budget covers day-to-day operations, field maintenance, pest control, landscaping, etc. Also, there should always be a reserve for any unforeseen events that may come up. If the HOA determines that the fees charged won’t cover the needs of the community, then the fees will increase.

A Beautiful Day In Hunters Creek, FL. Come Join Me!

I wake up to a dense mist over the pond in my backyard, the only things I see moving are the deer grazing in the open field. It gives me the feeling of living deep in the forest as I notice the tops of the tall pines towering above. Throughout the day I get regular visits by a wide variety of native birds that swoop into the fish-filled pond to grab their meal for the day. This is a common sight to see in Hunters Creek, FL. my favorite neighborhood in the whole world. It’s a crisp and peaceful winter morning as bicyclists and joggers make their way through the many nature trails located throughout the neighborhood. 

When you live and work in a neighborhood where the quality of life can be seen just by peaking out the window or grabbing the morning paper, you have no choice but to feel fortunate and blessed. As my two boys [8 and 10] reluctantly wake up to eat breakfast, my wife and I get ready for our morning bike ride through Shingle Creek Trail. On the way to the trail, our 3rd and 5th graders join us for a few blocks until we arrive at their school, West Creek Elementary, an A school with an impeccable reputation.

As we continue on our journey to the trail we cruise through the Vista parks which include: 3 soccer fields, 4 basketball courts, a volleyball court, 2 playgrounds, gazebos, and two dog parks… all within a distance of 1/2 mile! My boys both play competitive soccer for the Hunters Creek Soccer Club which is ranked one of the top clubs in Central Fl. However, if soccer isn’t your child’s sport of choice, Hunters Creek also offers youth basketball, baseball, football, tennis, and even a volleyball league.

The community center located in Osprey park which is less than a mile from my house has so many amenities including recreational activities, classes, and programs for residents of all ages. And when the weather is nice, they have movies in the park on Friday nights where you can bring chairs, blankets, and snacks to enjoy popular family movies under the stars.

On our way back to the house my wife and I who is also an Orlando realtor decide to ride through the new development of “Hunters Point” formerly known as “Kailey’s Ridge” to see how the construction of the highly anticipated new subdivision is coming along. The area will consist of 127 homes built by “Surrey” and “Ryan” home builders. So far, the streets and sidewalks have been paved but no sign of the first foundation being laid yet.

At the end of the day we all head over to the Alehouse located at the Hunters Creek Villages, to take advantage of the weekly BBQ rib special that they offer to residents. We are fortunate enough to have a wide variety of great restaurants, bakeries, delis, frozen yogurt, and pizza places all within walking distance. If shopping is your thing, “The Loop” just 2 miles away has everything you could wish for in a mall including a state-of-the-art movie theater.

Although Hunters Creek was voted the 21st best place to live in the whole United States, in my book it’s #1. It’s obvious that enjoy Hunters Creek, the place I call home and I would love the opportunity to show you any of the limited amounts of homes that are for sale now as well as in the new community of Hunters Point. Bidding in a Hot Market

Buyers looking for that perfect home in Orlando are finding out that they need to prepare for a fight. Because of a hot market causing lower than normal inventory, hungry buyers are engaging in bidding wars every day. Bidding in a hot market can be a fight and lately, it’s been all about who’s quicker to the punch.  

In a seller’s market, homes sell super fast once they’re listed on the MLS. Getting your offer approved amidst all the competition can be a huge challenge. In this situation, many factors are just out of your control. However, there are certain steps that you can take to make your offer more attractive to the seller.    

When house hunting, you should enlist the help of an Orlando buyer’s agent as opposed to trying to go it alone. Weeding through dozens of homes by yourself that you find on the internet to find one that suits you just isn’t very fun at all. Once you’ve found one that you love, then it’s time to place an offer on it. Many buyers will already have a number in mind but if you’re not sure how much to offer, however, your realtor should be able to assist you in finding the magic number. Experienced realtors can prove to be extremely valuable in this situation by providing the buyer information about the area like recent comparables of other properties in the area.    

Tips on getting your offer accepted, Bidding in a hot market:

  • Get your financing in order. Speak to your mortgage broker or lender before you even start looking at homes. Knowing how much mortgage you can afford in addition to having a pre-approval letter will put you way ahead of the game. You should also know that being pre-approved and pre-qualified are two different things.

The difference between Pre-Approved and Pre-Qualified

  • Pre-qualifying for a loan basically means talking with your lender about your financial situation, income, etc. then the lender will give you an approximate amount of how much you SHOULD qualify for.
  • Pre-Approval includes submitting a loan application together with income statements, a list of assets, a list of expenses, etc. With a complete loan package in hand, your mortgage broker will be able to shop out a loan that would meet your specific needs. It also gives the seller peace of mind knowing that your contract is solid and won’t fall through because of financing.
  • Don’t submit a lowball offer! In a hot market, many properties sell above the listing price. Submitting too low of an offer is the best way to get your offer denied and you may not even get a chance to counter, especially if there’s another competitive offer on the table.
  • Give them a bigger deposit than they asked for. Putting down a larger deposit, allows the seller to see how committed you are to making the deal happen.
  • Eliminate as many contingencies as possible. If the seller has to worry about the buyer selling a home or appraisal value falling short, etc. Then the offer becomes less enticing to the seller. By keeping your contingencies to a minimum, the better your offer will look to the seller.
  • Pay cash. For most people, this isn’t even an option. However, if you’re able to submit a cash offer with a quick close then this will surely get your offer to the front of the line.

Even if you do everything on the list above, it still may not get your offer approved. But by doing as many things as you can to make your offer more attractive to the seller, you’ll know that you did everything in your power to get that offer approved. If it was meant to be then you’ll be living in your dream home real soon. New Homes In Orlando Getting More Expensive

In 2014 new housing developments in Orlando became increasingly more expensive throughout the year and we can expect to see more of the same in 2015 according to Orlando Realtors. This is in part due to newly retired couples looking for a permanent move as well as vacationers wanting to have a new home away from home.

Prices on new homes in Orange county are scaring some buyers away. In fact, when compared to Lake and Osceola counties, Orange County leads the way in price per sq ft. for relatively the same quality home. Builders say that retirees and vacationers have been able to tap into their investment savings in recent years and use them to reinvest in Orlando real estate.

The rising prices of new homes in Orlando have been evident in both the high end as well as lower-end homes. New home builders see the trend and continually try to offset the higher prices by offering incentives to buyers that struggle to qualify for mortgages, especially the people that lost their homes in the market crash of 2007 to foreclosure or short sale.

Reducing the number of upgrades, less customization on the homes as well as reducing closing costs to a minimum are the most popular ways to discount pricing. Even with builders scrambling to find ways to keep costs down and increase buyer incentives, higher prices may still price many potential home buyers out of the Orlando real estate market.

However, even with the higher-priced homes, closings on new homes in Central Florida overall have continued to increase during the past year. South Orlando seems to be Central Florida’s strongest area for new home building with over 1,200 housing starts in the third quarter of 2014.

Approximately 1/3rd of those homes were in the Lake Nona area development which was the most activity for single-family residences for the quarter. Overall during the third quarter of 2014 builders began building more houses than they had sold.

 New Homes In Orlando Falling Behind Schedule

This may be the cause for other developments like “The Point at Hunters Creek” formerly known as “Kailey’s Ridge” to fall way behind schedule. This development located in the much sought-after community Hunters Creek was to consist of 134 single-family homes built by both Ryan Homes and Surrey Homes and was expected to have homes for sale by October of 2014.

We’re now in January of 2015 and the new development has only gotten as far as clearing the land and paving the streets. Many potential buyers that have been patiently waiting to secure one of these new homes have opted instead to buy an older home in the community.

Kailey’s Ridge Update

Floor plans and pricing for Kailey’s Ridge in Hunters Creek are being finalized by both builders and are expected to be ready within weeks. With the entrance roadway now paved, construction moves to the next phase of development. The builders (Ryan Homes and Surrey Homes) will each control 50% of the 134 homesites and are scheduled to begin construction on the actual homes by the end of September or the beginning of October of this year. The development will cover about 53.4 acres of land.

Home prices are expected to run between the 3 to 4 hundred thousand dollar range and provide buyers with top-quality residences with some very attractive and functional floor plans to choose from. The plan is also to provide a rural feel to the community for future residents which is why at least thirty percent of the new subdivision will remain protected and unspoiled.

 Hunters Creek Roadways Will Remain The Same

As a follow-up to my last article about Kailey’s Ridge “Kailey’s Ridge Underway Residents React”  Many residents will be very happy to know that the roadway leading into Kailey’s Ridge will not be connecting to any other road. The plan was to have the road connect to either Osceola Pkwy or International Drive. There were even plans to connect the road to 535! As a resident and realtor in Hunters Creek, I’m glad that the Hunters Creek Community Association would not allow this to happen. Developers agreed to pay the  $2,700.00 per lot in order to be part of the HCCA. There will be additional fees to pay by the builders as well as the homeowners as the development progresses.
