Orlando Home Buyers Having to come out of pocket to settle with HOA Bullies

Homeowner Associations have gotten tougher and tougher to negotiate with over the years. It used to be that an Orlando homeowner trying to short sale their house wouldn’t have to worry about paying their delinquent HOA dues until the closing date. Not only that, but they would also settle for a fraction of what is owed to them, usually about 10% or less in most cases. Those days are long gone!

What we’re seeing more and more is that the HOA’s are trying to bully Orlando realtors as well as the homeowners into getting the entire amount of what is owed to them. If they don’t get their way, they take to property to foreclosure regardless of what the lender is doing. HOA’s are fed up with being put on the back burner every time and now they’re taking it personal. They are also very aware of the law, HOA’s are entitled to get one year of past dues if the lender takes the property to foreclosure. They also know that it’s much easier for them to foreclose than a bank [no proof of ownership necessary, no issue with robo-signed documents ]. A completely different animal than a bank foreclosure.

Once they get the property into their possession, they rent it out. HOA’s know that even though it costs them a couple grand to foreclose on the homeowner, they are now able to rent rent the property out and recoup some of the loss. Many times they are able to make thousands of dollars just because the lenders take so long to foreclose.

I personally think it’s ridiculous that an HOA would foreclose on a homeowner because of a few thousand dollars in past dues. Unfortunately, there is nothing that can be done about it, especially when they’ve already hired an attorney to handle all negotiations. I can tell you there’s nothing more frustrating than having an Orlando short sale 90% complete and the only thing holding up the deal is settling with the HOA. All your negotiating with the lenders is done, they’ve both given you payoff letters, and they’ve also given you 30 days to close. The only thing left to due is get the HOA to give you a discounted payoff letter and you’re golden.

The problem is that they want either the entire amount or an amount that is very close to full payoff! Unfortunately, if they don’t budge, then either you figure out a way to get them their money or the deal falls through. As an experienced Orlando realtor I will take a cut on my commission just so the deal will go through. Most of the time however, this isn’t enough for them. Sellers usually can’t afford to come up with any money, and the only ones left that can make the deal happen are the new buyers. Even though that debt has nothing to do with them at all, we have to make them aware that if they don’t pay it, they don’t get the house.

Hunters Creek, FL comes in at number 21 for best places to live in the U.S.

Twenty-one is a pretty good number considering all the great places there are to live in the entire US. As a resident and business owner in Hunter’s Creek, I’m very proud of my neighborhood, but Hunters Creek Real Estate has definitely had its share of ups and downs. When the crash of 2007 happened, houses that were worth 500k were all of a sudden worth somewhere in the low 200’s, I know this all too well because that’s exactly what happened to me.

Our house actually appraised at 580k in 2006 and ended up all the way down at 220k appraisal value in 2008. Although that was a hard fact to face, we really loved the beautiful and kid-friendly neighborhood, and that was priceless to us.

Having two young boys, one of the biggest attractions for us was all the clean and perfectly manicured parks. You can definitely tell that when they started building Hunters Creek 25 years ago, they had young families in mind all the way. There are playgrounds, soccer fields, baseball fields, football fields, basketball courts, tennis courts, and racquetball courts for residents to enjoy. Hunters Creek also has youth sports programs for just about any sport you can think of for children wanting to participate. There are also gazebos and community centers that can be used for private activities.

Shopping and Restaurants

Hunters Creek is conveniently located close to several good restaurants right there in The Village. Wherever you live in Hunters Creek, you’re only a few minutes away from a healthy selection of family restaurants, pubs and there’s even a Farmers market. If it’s a mall your looking for, try going to the Loop. It’s just minutes away and it has a wide array of stores as well as a movie theater.

Over the years we’ve seen enough animals in our backyard to start a zoo. We’ve seen deer, turkeys, river otters, bobcats, foxes, wild boar, bald eagles, sandhill cranes, and owls just to name a  few. With ponds everywhere, most residents are able to go fishing, kayaking, or canoeing without even having to drive. Although we’ve seen small alligators in the water, the larger ones are removed by animal control and taken to Gatorland.

Shingle Creek Trail is a beautiful conservation area that consists of hiking trails, bike paths, lakes and there’s even a

trail that travels along the side of Shingle Creek where people go kayaking, canoeing, and fishing. We often go bike riding through the trails because my boys love it.

Orlando Short Sale Closed After 3 1/2 Years Battling with Lenders!

The longest Orlando short sale in our company history.

I had just had to share this story about an Orlando short sale that we’ve been working on for well over 3 1/2 years.

We started this file in December of 2008 It was a pretty common story; She had a 1st mortgage with GMAC for 434k and a second with Bank of America for 116k and she also owed her HOA $5,000.00 at that point [now $15,000.00].  The big problem was that even though she owed about 570k since she purchased in 2006, her house was only worth 180k at the point when we took her on as a client in 2008.

Throughout this process it was a matter of getting all the stars to line up at once , which when your dealing with 3 different debtors is no easy task. Buyers get tired of waiting, lenders wanted new bpo appraisals done every 6 months, the HOA didn’t want to budge and we had to stop her Orlando foreclosure several times.

No Attorney Necessary.

In the past three years we’ve had 7 solid contracts, 9 bpo appraisals and we stopped the foreclosure sale date a total of 6 times.s, we eliminated her debt. We closed last week with a cash offer for 200k and to top it all off, we got the lenders to give her $7,000.00 back at closing.  By the way, she never once went to see an attorney which means probably saved another 7 to 10 thousand dollars.

Doing the short sale was the best decision for her.

In the end my client got to live rent free for 3 1/2 years and was able to save up some money and turn her life around. We found her a nice rental in Downtown Orlando and she now lives comfortably within her budget. How’s that for a bailout plan?

It’s true that we had to work work many times harder than a typical short sale file just because of constant updating of expired short sale docs  alone, not to mention all the buyers we lost along the way because they got tired of waiting on an approval.

However, when you’re in the short sale business, there is no greater satisfaction than to know that you’ve helped someone solve a huge problem in their life and get a fresh start.

Make Your Orlando Home Appealing to Buyers

Give Yourself the Best Chance at Selling your Orlando Home

If you’re trying to make your Orlando home a bit more appealing for a potential buyer, then there are some things that you should consider.  First of all, not everyone has the same taste as you and so that’s why you should keep it simple when staging your home to be sold.


Never leave things out like family photos, personal keepsakes, and treasured belongings. All of these items should be safely packed away which very often creates open space. Everyone loves open space, it makes the home feel bigger and people can get a better feel for the layout.


Believe it or not Orlando home buyers often make a decision within just seconds of seeing your home about whether or not they want to buy it. So remember that and picture your home through the eyes of your potential buyers. What impression do you get in the first 30 seconds?


Sometimes a neighbor can help you out with this. If you do ask someone to give you an honest opinion about the first impression they get of your home, don’t take it personal if they don’t like some of your choices as far as decorating, just listen.


Here’s a List of easy things you can do to increase your chances of getting a contract on your Orlando property

•    Remove all loose clutter inside and out.  When you walk up do you see children’s toys scattered across the front lawn or throughout the house? Get rid of it something as simple as clutter can be a deal killer.

•    Make sure your yard and landscaping looks as good as it possibly can. Overgrown trees ,  shrubs and grass are eyesores and it’s the very first look that they get at the home.

•    I think it’s always good to get a fresh paint job when selling a home. It makes a huge impact and is relatively inexpensive to do. If painting is not an option, at least touch up any spots that are chipped wore out or can’t be cleaned.

•    Remove any furniture that is causing the house to look smaller or that is in the way when you show a potential buyer your home. Most of the time less is more when it comes to bulky pieces of furniture that can absolutely change the look of a room.

•    Add artwork to long hall ways. You don’t have to buy artwork that costs thousands of dollars but, if your home has long hall ways, it’s nice to break up the monotony with some tasteful artwork. Use contrasting shades and hues to coordinate with the flooring. When you’re shopping for the artwork or borrowing it from a friend or your real estate agent or homestager, if possible bring swatches of the carpet or flooring and wall paint to match the artwork colors.

•    Make the kitchen a focal point. Whether they cook or not, the kitchen is of primary interest to many buyers. Winning over buyers with an appealing kitchen can often convince them that they must have the home. Make sure your appliances are clean, sparkling, and working. Return on investment in the kitchen is usually high and worth every penny, and more, you put into it.

•    The bedroom needs to look like a bedroom. It sounds funny, but many people use their bedroom for other things such as an office or storage. Boxes or newspapers are scattered or stacked in a corner. There’s no “ah” or sense of relaxation with that kind of room. So even if that’s how you’ve been living, understand that’s not how you should show a home.

Making your home more appealing means seeing your home through the eyes of your potential buyers. When you start receiving more offers than you know what to do with, you’ll be glad you did.
